As a parent, you know you'd do anything to keep your children (and fur babies) safe and protected. After all, your role is to act as a safe place for your child as they navigate the ups and downs of life. But what would happen if you could no longer be that safe place?

Appointing a Guardian

Guardianship under Wills applies in the unlikely event that your children and/or pets become orphaned. When it comes to choosing a person (or people) to be a Guardian, you simply need to nominate two tiers:

1. Primary Guardian; and
2. Alternate Guardian (if the Primary cannot fulfil their responsibilities for any reason).

Guardianship when Co-parenting

If you have parenting orders which stipulate what would happen if one parent dies before the other parent, then these orders will generally be followed. If you do not have orders that cover this, the Court will likely consider your wishes relating to guardianship in your Will, along with any other competing claims for guardianship, and will make a determination based on the best interests of your child.
